Unfair Terms: The CMA’s Guidance has now been issued

The UK’s Competition and Markets Authority (“CMA“) has now issued its guidance on unfair terms, further to the expected commencement of the Consumer Rights Act‘s (“CRA“) key provisions on 1 October 2015.

This document will be relevant to almost all UK consumer facing businesses as they review their terms and conditions in preparation of the new consumer laws being introduced by the CRA.

Of particular interest will be:

Part 4 – covering the blacklisted terms and notices (including how they relate to the newly defined category of Digital Goods)

Part 5 – the Grey List and Annex 1 which sets out examples of unfair terms.
